A women can get maintenance from 498A, 125Crpc, and DV act, whether she earn more then Husband. But she can claim from only one not from all. Maintenance can be denied on various grounds.
Dear Vishal, As per prevalent statutes like Hindu Marriage Act, Section 125 of Crpc, D.V.Act a woman can claim maintenance while divorce proceeding. The amount of monthly maintenance is decided by court only. Various factors are considered by the court while deciding amount of maintenance to be paid by opposite party(husband). Hi, as per the concept of maintenance, a husband is liable to maintain his wife after divorce untill she remarries. The sec 125 CrPC deals with this. You can present the necessary documents providing that she earns twice as you do but the final discretion shall be of the court only.
Only issue permanent maintenance can be addressed under the provisions of Section 125 of Code of Criminal Procedure but for divorce the parameters are different. If wife is earning more that has got to be proved and court will decide the issue accordingly.
