Dear client, I understand this is a difficult situation. Here are some ways you can address your husband's petition and the issue with your mother-in-law: Responding to the Petition: Consult a Lawyer: It's advisable to consult a lawyer specializing in family law. They can guide you on responding to the petition effectively. Explain Your Reasons: The lawyer can help you draft a response that clearly explains why you don't want to return home due to your mother-in-law's behavior. Evidence of Harassment (Optional): If you have evidence of your mother-in-law's mental torture (e.g., witness accounts, recordings), provide it to your lawyer. This can strengthen your case. Seeking Resolution: Mediation: Consider suggesting mediation with your husband. A neutral third party can facilitate communication and help you both reach a solution that works for everyone. Separate Residence: If reconciliation seems difficult, explore the possibility of your husband living separately from his mother. This could be a temporary or permanent solution. Counseling: If there's a chance of working things out with your husband, couples counseling can be helpful. A therapist can provide tools for better communication and conflict resolution. Protecting Yourself and Your Children: Safety First: If you feel unsafe at home due to your mother-in-law's behavior, prioritize your and your children's safety. Consider seeking temporary shelter or a restraining order if necessary. Child Custody: If the situation progresses towards separation or divorce, discuss child custody arrangements with your lawyer. If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
