Asked in Elder
Dear Anil There is no legal compulsion on you to maintain your father, but its moral and ethical compulsion to take care of parents at this stage of life, when they need more care. You can take this in your defense, that the pensioner has sufficient means to maintain himself, if he file maintainence petition under senior citizen and procedural laws.
Since your Father has a sufficient source of income to maintain himself and also own deposits for his life. At present it is not mandatory for you to maintain him. But if he comes out with a plea under some provisions of law before some authorities then you have to prove and establish the facts to wriggle out of the situation. Follow me, contact me after reviewing my resume if any further discussion or explanation is required.
In the event of your father having financial capacity to support himself i.e., pension, income from investments and other income, you need not maintain him. However, you need to prove the same showing that he is self sufficient to support himself, if he seeks maintenance against you.
No, but you must establish the same before concerned authority if he claims that you have to maintain him. He might be putting false claims and not disclosing his source of income. Please give me Rank 5 and Review my Resume and Follow me if my answer satisfies you
As long as your father able and sound state of Mind you cannot seek any remedy under law.
