1. your mother can file a complaint under the maintenance & welfare of the parents & senior citizen act to evict her son from the house, The Delhi High Court had ruled in 2016 that an adult son had no legal claim on his parents' self-acquired property. “Where the house is a self-acquired house of the parents, a son, whether married or unmarried, has no legal right to live in that house and he can live in that house only at the mercy of his parents up to the time the parents allow” said the order. 2. The Bombay high court (HC) has held that senior citizens tribunals, established under provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, can evict abusive children from the resistance of their aged parents even if it is an ancestral property.
Hi, You and your mother can file a complaint against your brother for mental harassment for property share and can also ask for maintenance. If your mother do not want to transfer the property she can make a will or a gift deed. If you find it helpful, please rate my answer. Thank You
