    you have to approach Labour commissioner.. Usually Labour courts are presided by Deputy Labour Commissioner of the respective district.. You can also hire a lawyer to do it efficiently..

    Rule is common for all employees as per the provision of gratuity act. If you worked more than 5 years in that company, you are eligible for availing the benefit of gratuity.otherwise, gratuity amount will be lapsed.calculation of gratuity as follows :— Average of 10 months of Last drawn basic salary *15/26* No of completed year of service. Note -period which beyond the completion of 6 months, it shall be considered as full year of services.
