Public Sector Pension Related Matter

SIDBI intro Pension Regulation in 1993. Hwevr, the same was rendered invalid as same was not placed before the houses of parlment and was not Gazett notified as reqd by SIDBI Act 1989. This was pointed out by the Rajyasabha Comttee on Subordinate Legislation and SIDBI was asked to pass the PR afresh (not in supersession of 1993 reglation) which was done in 2002 by concluding the required formalities. Although option was given to employees under 1993 PR some had opted for retaining CPF. However as per the PR 2002 SIDBI should have given option as per the provision of the 2002 PR , No option was given, meaning that all employees became deemed pensioner not having exrecised any option. Howver 150 employees are still being wrongfully treated as CPF optees. My question is: when the 1993 PR is treated as null and void whether option given by SIDBI under 1993 PR is valid. Since SIDBI has not called for option as per 2002 PR (only valid PR) , are all to be treated as pensioner by default.
