thats a debatable point in law.. but there are some favourable judgment for u, (provided u obtain decree in Sec9 case.. ) book for consultation if u need judgment in this aspect.. i.e. if exparte decree obtained by husband and wife didn't comply that order, then she is not eligible to claim maintenance..

if she files divorce, u leave the case exparte.. that is the better way for quicker divorce.. if maintenance is ordered along, Later u can file petition for modification, if u have good grounds..

Permanent Alimony is for mutual divorce.. In contested case monthly maintenance only be asked which u, for ur convenience can convert to permanent alimony.. however if u have good case, u can win the case without maintenance/ alimony, but it will take time.

They can file.. but any one court or High court may transfer the case to same court.. They will insist for mutual divorce.. but if u want divorce then let the other for exparte, that's the best way..
