1) You cannot take divorce within 1 year of your marriage. 2) Secondly, when you will file a divorce petition the court will send you for mediation. So it's advisable to try and meditate and see if it doesn't work then only file a petition. 3) There are 2 motions in Divorce and there is a waiting period of 6 months between both the motions. First of all, you both should go the conciliation and try to work out your problem but in case you both still want to obtain a divorce than first settled the terms and conditions regarding alimony etc and then file a petition for mutual consent divorce. The court will give you the date of six months to reconsider your decision then after six months, you both will give your statement before the family court wherein you both want a divorce than after recording the statements of both the parties the family court will grant a divorce. You told yours is a love marriage then what happened not even a year completed you have come to this decision, as per my personal opinion divorce cannot be the ultimate solution to your problem first have one conciliation in the mediation center before coming to any decision.
