I am resident of Maharashtra and want to file a divorce. I am not sure where to start with. Following are my details Married in - 2007 Child - 1, age - 11 Separated since - 4 yrs. Spouse location of living - Pune My location of living - USA. Reason for divorce - Difference in the living & arguments and her history of the affair. Child Support - I have been taking full care of it in those separated years, including school fees and other medical expenses. She lives in my flat in Pune and we are not in contact except for child support. Following are my questions to be answered 1. Can I nominate someone to file for divorce. 2. She says to have a mutual divorce but I doubt and it could go contested divorce filing. How to proceed in this case. 3. How long it takes if it is a Mutual divorce and what are the steps and processes involved. 4. Since we are separated since 4 years, how long would it take to get a divorce Thank you, Regards,

Dear Sir, Mutual divorce can be granted within six months if cooling period 6 months is waived off. Nobody can expect the time span required for disposal of a matrimonial case. Please give me rank after viewing my details. Please call me for further assistance.

And you have to appear personally you cant appoint anyone on behalf of you. Court can also take your consent through videoconferencing .

If both of you are agree for divorce then you can file application for divorce with mutual consent . When you file the mutual consent divorce festival both of you have to appear before the family court , Initially could refer your matter for mutual consent . If matter is not settled between both of you . Then the court asked both of your consent . After getting the consent from both the side court posted the matter after 6 months . After 6 months both of you have to appear before the court and then you have to file an affidavit , Giving your consent to the divorce. Then the court passed the order and judgment for separation . As per the latest judgment of supreme court this period of 6 months can also be Skip . A number of cases we take 1 week or 2 week date And after 2 weeks the court can pass the order and judgment for separation .
