I got divorced in Australia. I and my wife both are living here. We separated in 2018, after 1 year of Separa I filed for divorce, which was served to her giving her 6 weeks to reply. Upon receiving the application she through her dad filed dowry, physical and mental harassment case in India (no fir filed yet.) During the first hearing my wife contested disputing the separation date and also requesting the court to dismiss the case since a dowry case against me and my parents in India and the divorce in this Court will hinder the dowry and another harassment case in India. The court gave her two months' time to submit evidence for cohabitation. She didn't turn up for second hearing instead of filed an affidavit accusing me and my family of dowry harassment and didn't submit proof for cohabitation. Now divorce is granted and registrar said it's uncontested as she didn't turn up. but I want to know is this divorce valid. She contested the divorce on affidavit. Please assist.

Foreign Decree is not valid because you must have obtained in her absence. If she Contested legally there then Local Court cannot entertain her. Find good experiences Criminal Lawyer who will defend you . As per Law Giving and Accepting Dowry is Crime. Take Services of any Lawyers in this Forum for your relief.

Divorce decree is valid until set aside. You got valid divorce decree and until it is not being challenged, this will be operating. It doesn't matter whether it is contested or otherwise. Book Consultation for further help.
