Yes, if not filed you will have to lead evidence. On one fine day he will come to court with objections. If rejected then approach the HC and HC may ask the Magistrate to receive it by condoning the delay. The case come to Square One.
madam pl give full information if you have already filed a separate application for maintainance both to u and ur child pl persue the matter concerent to dvc you will get orders
You would have already filed Maintenance petition which is inclusive in DV Act itself.. u'll get maintenance order too..
you will get orders as prayed in your application
then u can get all relief as exparte order based on your side evidence alone.. if they file exparte set aside petition later the same will be allowed only after cost..
if they don't file counters after grant of stipulated time the court may pass exparte orders against your husband
if not the file counter you'll get exparte order.. Normally court leave time for 3 or 4 hearings at 1 month interval.. then they will set exparte.. However court can pass any interim order at any stage, irrespective of filing of their counter..
