Hi, you are the legal heir of the property but before that its your mother who owns the right over the property, which can be claimed fully by you. since the bank account has your mother's name as a nominee, you can not have the amount. however you can do the following things: 1. you can transfer the amount from your fathers account to your mothers account by writing an application to the respective bank manager. you need to attach the Death certificate of your father along with the letter. once the amount will be transferred to her account, your mother can make you the nominee. 2. if you want to avoid the above steps, you can directly transfer the amount from your fathers account to your mothers account or to your account through online mode, provided that your mother has agreed to do so, since she is the nominee. 3. it is also advisable to ask your mother to make a will of this property to avoid any further future hussle. Though you are legally entitled to a share from the property of your deceased father but since there is Nomination you have to approach the Civil Court for getting your share because the financial institution will not disburse you money directly.
