If case filed against husband mother father and sister u can file quashing in high court.even if u have ground for quashing u also can file quashing petition before high court.
Greetings! Incase the FIR is based on vague and omnibus allegations against the family then it's better to file a petition for quashing the FIR before the Hon'ble High Court. You may take consultation for further legal assistance. Regards.
Dear client I am sorry to hear that but in case you are getting harassed from your partner then you can go ahead and file a complaint against them to your near by police station. Over you can also file a restitution of conjugal right and a section 9 of Hindu Marriage Act if you want to stay with her however if you want to go head for the first then you can file a mutual consent divorce
1. You all have to File Anticipatory Bail in court through lawyer and after obtaining Bail You can File FIR Quashed Petition Before Honble High Court to delete names from FIR. 2. Your brother can issue notice through lawyer to come back and if she refused to come back then File Restitution Case in court through lawyer.
Dear Sir, Such cases are many and there is nothing unusual in the conduct of your sister-in-law. You have to just protect her false cases by going to High Court and to get quash the pending 498A case and also DV case. In the meanwhile if interested your brother may file Divorce case for desertion and cruelty.
If you are getting unnecessary harassment from your partner then you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. As far as the DV and other cases are concerned you need to file a strong reply/WS in your favour and annexure all the evidence you have got with you. And if you wish to stay with her then you can go for section 9 HMA and if the situation is unsecure for you and there's no scope of living together then rather stretching the relationship you should file for a contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
