A senior citizen mother has one married son and one unmarried daughter. Father has expired long ago. His property was sold and the amount received was equally distributed among mother, son and daughter as per father's wish. The mother is staying with the married son in son and daughter-in-laws's owned house. The son takes care of her maintenance expenses (like food and housing). The mother takes care of her other expenses (like medical and clothing). The daughter is unmarried, working and staying alone in her owned house. The daughter has decided to stay unmarried for rest of her life. Is it legally binding that only the son should keep mother in his house? Is the unmarried daughter equally liable to keep her mother at her house?

As per the provisions of Maintenance and Welfare of Parents and Senior Citizens it is incumbent upon both the Son and Daughter as well to maintain the Mother. If not being properly maintained Mother can claim through legal process. Under Maintenance and Welfare of Parents and Senior Citizens Act, 2007 the maintenance can be claimed by parents, grand parents and senior citizens. Adult Children in case of Parents and adult grandchildren in case of grandparents, both male and female, are responsible/liable to pay maintenance to parents and grandparents.

Hi, both male and female, are responsible/liable to pay maintenance to parents and grandparents. In this situation, it is the duty of both the son and daughter to share the expenses of the elderly parent.
