You both will be required to furnish Affidavit of Assets & Liabilities before the concerned Courts, Your wife will be bound to disclose her real income and incase she depose falsely you will be at liberty to prosecute her for deposing falsely before the Court.     Dear client I am sorry to hear that but in this case you can go ahead and talk to her boss and try yo collect some evidence like salary slip etc. After that you can argue that she is not entitled to maintaince as she is earning quit well.

    1. Yes, You have to prove in court that she is working women. 2. she is getting handsome salary from IT Office. 3. She can maintain her herself. 4. She is not depend on anyone for food, clothing, shelter . 5. You have to prove in court by Filing her all documents which shows that she is working women. 6. You can call her Boss as a witness in court to prove that she is working women under his supervision. 7. You can also call all her service documents through court.

    If your wife is earning and is capable of maintaining herself then she will not be entitled to any maintenance. You both need to furnish an income affidavit in the court where you have to disclose your assets and liabilities and other information to the court. Any misleading information is a punishable offence. If you and your wife have already filed the income affidavit and your wife is showing that she's not earning then you can simply file an application as a reply to the said income affidavit or you can always go for an oral argument in the court regarding that she's earning. Any evidence like salary slip or appointment letter will be enough for the court to dismiss her maintenance application. For more legal assistance I am just a call away.
