Dear Sir, In your case there is no contempt of the court order. So there is non requirement of file FIR.

The provisions of Contempt of Court comes to play only if there is a violation of any orders of the court such as an injunction. hi sir you can give a complaint in a police station and fir should be filed and file a application for a construction of property during the pendency of case if there is stay you can file a contempt of court.
