My parents have passed away. They haven't left any will behind. We are three siblings, one brother and two daughters. I am the youngest daughter and I live in my parents house since a while back (from sometime when they were alive) and am living till date. I took care of my parents expenses and the complete expenses of the house when they were alive and now too I am the one paying all the bills. After my father's death I have been paying the house tax also timely every year. Because of problems in my marriage I had to stay at my parents place with my kids. My financial conditions are not very strong either. My brother has died, now his wife and children are left behind. I want to know if there is a way in which the house can be legally given solely to me. Also, should I continue paying the house tax(which I have been paying since a long time)now if the property is eventually going to get divided between 3 siblings? Will I have any benefit of paying the house tax?

Hello Ma'am If a person die without a will, the probate court will refer to local “intestate succession” laws to decide who will receive the property. The order of succession usually prioritizes the surviving spouse or domestic partner, followed by the children, then parents, siblings, and extended family members. Dear Sir, Section 8 of Hindu Succession Act: ==================================================================== General rules of succession in the case of males.―The property of a male Hindu dying intestate shall devolve according to the provisions of this Chapter:― (a) firstly, upon the heirs, being the relatives specified in class I of the Schedule; CLASS I Son; daughter; widow; mother; son of a pre-deceased son; daughter of a pre-deceased son; son of a pre-deceased daughter; daughter of a pre-deceased daughter; widow of a pre-deceased son; son of a pre-deceased son of a pre-deceased son; daughter of a pre-deceased son of a pre-deceased son; widow of a pre-deceased son of a pre-deceased son.
