Society Maintenance Issues By Upper Floor Owner

Hello I am living in the gujarat. My upper floor neighbour's house is vacant. He is not maintaining his house well. In rainy season his house at 4th floor is getting full of water due to window leakage and wall leakage. When his floor accumulates enough water then it is draining down side through our common slab and wall. Now my house is getting droplets of water and accumulate water down side. Now upperside owner denied to repair his window and tiles on floor. What action can I take for this? Should I file complain in rera or court ? I need quick action I m fed up with this owner. My things are getting damaged.
