What is the age of child who is claiming partition? As per law within three years after attaining majority he can claim partition of only existing properties and not properties which was already being sold. Now whether sale is genuine or not that is a matter of trial and the child could challenge sale deed with three years from the date of his attaining majority. Let the child file suit for partition where you can put your stand. Child should not be permitted to blackmail you in such manner.

Sir, technically an order from the concerned child services authority should have been obtained before selling off the property by you. However, currently you can ask your nephew to file a partition suit with any claims that he has and therein you can show proper documents showing the expense incurred for raising the children by you and that due to such expenses you had to sell their share of the property. However, ultimately the decision of the court will prevail so it is important that you seek legal advice from an advocate by presently all documents related to the property and details of expenses incurred by you for upbringing the children.
