Sir I am working in an educational training company and the company has not payed me salary from 4 months due to which I am resigning from my job. The company is asking me to serve the notice period of 1month which I don't want to serve. Since due to non payment of job I have faced many financial problems and I have already applied for a new job and have to join there at the earliest. The company has not put any money on my training and its not even a properly registered company. Do I have to pay the amount for not serving my notice period. What steps should I take to get my 4 months salary back. Can my employer halt my 4 months salary if I don't serve my notice period. I don't want any experience or relieving letter from my current employer.

check your appointment letter about the probation period. if you resigned without proper notice in probation period employer need not to pay. If you have peoper documents pls approach through labour court.

You can file a suit for recovery of the amount due to you. If the order stipulated notice period you have to pay equivalent amount, if not no.
