In your case you need serve him/her a legal notice first and in that notice you can write all your grievances to stop all these harrassment and return to work as soon as possible or else the company will terminate you without giving any other further notice. You have to warn him/her that either join the company or face legal action which will be at their own risk. In that way you will be secured if he/she files any fake cases in future.
