Hi, I worked for a company in Bangalore from June 19, 2006 - Mar 31 2011. I have not been paid gratuity till date. When I approached they say , during the period I left, as per the Gratuity Act, they have paid the Gratuity payment only to those who have completed 5 years of service. I would like to know if I am eligible to receive gratuity or not.

This is my response to you: 1. Gratuity can be given to all persons who have completed 4 years and 10 months; 2. Technically speaking you have completed 4 years and 10 months on March 19, 2011; 3. So send them a formal letter addressed to the HR; 4. If they do not pay up then send a legal notice; 5. Last step is to approach labour court.
