Pending Salary And Other Expenses

I joined the present company on 25th Aug 2019 in Noida.I got the salary of Aug and September 2019 only. 5 months salary pending. The owner always says that he is in financial crunch. I gave him Rs. 6 Lac in his personal account to complete pending work from my home loan top-up amount. I have my appointment letter transaction slip of rs. 6 lac of his account. what more documents required to go for legal action, I am not able to survive any more without money. Is it the right time to go for legal action or i have to wait for more days. I am still working in the same company.
