It's not true If you file a complaint directly before Labour Court then it can take maximum 6 months for disposal of the case. It's in the Act

I have done a same case related to your issue. File a complaint before the Labour Commissioner, if it's not solved then they will forrward it to the Govt. Labour Welfare Department & then a reference will be made to the Labour Court. Labour Court case disposal time frame is 6 months. You can claim even compensation with that. My case got disposed within 3 months. So, don't worry and take the step.
