Land Kharab

Respected... There was Land of 13 gunta. This was shared between 2 children 6.5 gunta each. A and B Onside there was "a" Kharab..0.4 gunta..its was in RTC of B party. These kharab was for passing rain water. Everything was registered in 1994 with permission from both Party A and B.. Now this Son of Party B had gone to Court appealing that Even party A should also Share Kharab ie 0.2 gunta. So he is telling resurvey should be done excluding 0.4 gunta Kharab land and..share should be done with 13-0.4=12.6 So that he should get 6.3+0.4(kharab)=6.7 land in his RTC And party A should get 6.3 gunta. In 1994 itself Party B Father had agreed for making kharab in his RTC. Because there was rule that whose side is the kharab. He should get that because it's "A" kharab..Party B has agreed too, but now son is so interested to make some revolution by going to court. My question is wht would be the judgment..please share some info so tht we can proceed legally in better way
