  • hello sir. in order to recover your rent dues and the possession of the property, you have to send a legal notice under the transfer of property act, through an advocate. these days even online notices are being sent through email and whatsapp due to lockdown. after delivery of notice, still the person fails to pay the amount , you can move ahead with case. feek free to contact me.

    1. you can serve him (tenant) a legal notice through a lawyer to make payment of the outstanding amount along with the interest, 2. if payment is not made despite service of the legal notice, you can file a civil suit for the recovery of the amount along with the eviction of the tenant,

    Though it is not mandatory to send the Legal Notice. But however, to make the Tenant aware of the matter it is optional to send it. The lawyer you will appoint will serve the Notice and will also undertake the further process for getting the tenant evicted. The time frame for the finalisation of the case depends upon the working of the Court which will try the case.

  • You have to first appoint an advocate, then the advocate would send a legal notice to your tenant for payment of rent due and for his eviction. If, in a time span of around 15 days of the receipt of the legal notice the tenant pays you the rent due and leaves the property then its fine and in case he does not, then legal proceedings would be initiated against him. Prior step should always be sending of legal notice.
