    Dear Vijay, No need to be worried. First, if both of you ( landlord and Tennant) had entered into an agreement and fixed rent to be paid then Tennant is bound to pay rent according to agreement. If, as per tenancy act, 2017, Tennant is failed to pay the agreed rent consequently two months then landlord is entitled to initiate eviction proceedings against the former. Since, as per your claim, tenant is not regularly paying his rent you are entitled to evict your tenant and regain possession of your premises. Firstly, You have to send demand notice to tenant if he fails to pay due amount within reasonable time then you can file civil suit in rent court. To reply of your query regarding time period of completion of civil suit( eviction petition) this period 90 days is not mandatory the same can be extended. Apart from this, you are also entitled to claim compensation from your tenant.
