    Hi, Yes you file a divorce petition on the basis of mental cruelty, however the maintenance is to be decided by the court, also, if you want to keep the custody of your children you need to have the regular source of income. If you find this helpful, do rate us.

    The type of your question is ticklish and self contradictory. If you file a Petition for Divorce you may get on the Basis of Mental cruelty effected by your wife. But the difficulty is that you will not be able to wriggle out of the question of Maintenance both Interim and permanent as well and that too alongwith Litigation Expenses. Because Being able bodied and able to earn is the criteria these days which may put you in problem. Secondly, if you wish to keep both of Your children, it would be Mandatory to show an affluent source of income for bringing up the children. So, give a serious thought to Your Idea mentioned hereinabove.
