    Do not do anything in a hurry. Talk to your mother and think of getting this family issue reconciled among yourselves but if at all you have to proceed against your father under law then file a criminal case against him and also persuade your mother to do the same and file a case of maintenance and also protection and residence order against your father. You should consult a good lawyer without delay.

    Hi, The applicability of the Domestic Violence Act is religion-neutral and Muslim women are also protected by it. As a result, your mother should file a complaint against your father under this statute. Furthermore, if your father was injured when you were defending your mother from his beating, you would not be held accountable under criminal law because self-defense can be used to protect others as well. Self-defense actions should be proportionate, and you merely pushed him to save your mother while he was hitting her with an iron rod, and a single blow can often be fatal.     Hi, Yes son can defend his mother from domestic violence. • Firstly, you can approach the police for the help of a protection Officer, appointed by the government to assist victims of domestic violence. You can also approach any women’s organization or NGO in such matters. • You and your mother can file an FIR in a police station under the Domestic Violence Act 2005 and also under Section 498-A of IPC which deals with cruelty by husband or family members. If they fail to do so then, you can file a complaint before magistrate court or family court against domestic violence. • Your mother can also file for divorce and judicial separation against your husband under HMA and Special Marriage Acts.
