Dr. Verma , in India penal code section there are two types compoundable and Non Compoundable . Compoundable means they can pardoned or withdrawn by the Complaint either out side the court or Lok Adlath . Whereas Non Compoundable Offence cannot be withdrawn. But it can be Quashed by Higher Court . Contact any Advocates in this Forum for your relief

You mentioned filing of a false case. Is it a false complaint filed directly in the court or it is an FIR registered with the Police. Process is altogether different in both the cases. Frame the question properly and ask again. It would be more convenient for a Lawyer to reply effectively. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.

Dear client, Yes.. The complain is can be withdrawn but it will certain time bcoz you have to appear in court with your wife. The court will record plea. After plea the matter will be posted for evidence. Then your wife evidence will be recorded. After that your family statement will be recorded. After that complance, argument. At last judgement.

if it is a complaint then it can be withdrawn if it is a FIR then she will have to to change the statement in the court and you will be acquitted or you can file an application before High Court for quashing of FIR
