A wife who is treated cruelly involving domestic violence by her husband for dowry and physical assault, defamation, creating mental torture by the use of strong abuse language and invoking suicidal thoughts, threatening to kill her children and causing mental torture to an already bp and asthma patient, forcing to do immoral acts, not allowing the wife to perform basic religious duties. The husband has stopped the maintenance of the wife and children for three years despite having a source of income. Under these grounds, if the spouse files a case on her husband, will she be eligible to get maintenance from her husband. Given, they have two male children age 23 and 21 each and female child of age 16, all three pursuing their education. The husband owns decent properties both in Andhra Pradesh and Tamil Nadu.

Yes, wife can file maintenance case under CR.P.C. 125 , but if her husband is not able to pay maintenance or suffering from financial crisis....she may lose her case, but she can ask and fight for property as per her rights..... To see, her 2 adult children are eligible for earning money and other things to survive her....Now she file a case against her children for same.....under CR.P.C. 125, and by hook or by crook, her children have to maintain their mother....

Yes, she is entitle to get maintenance for herself and minor child. Section 125 of Criminal Procedure Code is applicable to Muslim divorcee also.
