To remain in extra marital relationship is not a criminal offence now and the only legal remedy available to your husband is to file divorce petition against you. For further query kindly book consultation.
Greetings! Your husband may file a divorce case against you but there are no criminal consequences of Adultery. For legal assistance you may book the consultation. Regards.
Adultery isn't a crime anymore but still ground for divorce.
The Supreme Court recently declared adultery as not an offence. However it is still a ground for divorce in the family court. So in your case your husband can't just go to register a FIR against your BF. He can only file a petition under section 13 for the dissolution of marriage. And if there's no scope of living together then rather than stretching the relationship you should be the first to file for contested divorce. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.
Dear client, adultery is no more a punishable offence under Section 498 of IPC. However a divorce Petition can be filled on this ground.
1. No, That's no more offence in the eye of law but that's a good ground for divorce.
Adultery is not an offence now in Indian. So your husband cannot take any legal action against that guy but you husband can file divorce case against you. But that depends on evidence he has.
