    While asking this for this quary is your status is that of a Buyer? Then there is a very clear way to serve a detailed Legal Notice and if the matter is not resolved go for a compalint under the provisions of Consumer Protection Act claiming all that what you have mentioned in this quary.     how are u concern with the query? if you are the buyer, serve the builder with a legal notice & if the matter is not resolved despite service of the legal notice, file a consumer complaint against the builder

    as the property is in the name of buyer so without his consent loan can not be passed you can file a case before RERA or consumer court for violating the rules if there is fraud then file a case before police
