You can file a FIR by walking in to a EOW office in person and they will file a FIR on your name. Since there are a number of buyers that you are representing, it is advisable to file separate FIR for each buyer. According to the case State v. Khimji Bhai Jadeja, the Delhi HC said that separate complaints should be filed by each buyer against the builder for which he would be tried and the punishment of each case would be considered separately. Therefore, every buyer can file a FIR against the builder separately. It’s important to note that the EOW does not take up offences exceeding the amount of Rs. 3 crores. So, if your case is for more than that then it is advisable to file it in the appropriate police station as a criminal case. Hi, EOW will only take up cases involving Rs 6 crore or more. However, a complex case involving less than Rs 6 crore but requiring specialized and cross-country investigation can be taken up by EOW with the permission of police commissioner.
