Issue him notice through lawyer and File Complain against him in consumer court and claim heavy compensation.
The builder has got no right to deduct the GST as he/she failed to provide any additional services. That was just the booking amount. I would suggest you to first of all send them a legal notice regarding your grievances. In that notice you need to warn them either return the 5% amount plus compensation or face legal action which will be at your own cost and time. For more legal assistance I am just a call away.
Dear client, GST is now refundable on cancellation of residential flat, as the builder is not providing you any service, hence no tax deduction. You may claim your money back as the builder is entitled to pay your money back.
