Asked in Property
the stamp duty never expired so it will be adjusted .
the sale deed can be executed making Mrs. Barge a confirming party to it. Mr. Barge will be the vendor. There is no problem with the title of Mrs. Barge. Her title now vests in her husband to whom she has gifted the property. If Mrs. Barge is acceptable as a confirming party by the sub-registrar's office and credit for the stamp duty paid on the agreement with Mrs. Barge is provided for the sale deed with Mr. Barge, then well and good. Otherwise Mrs. Barge will have to apply for refund of stamp duty by making an application to the Collector of Stamps.
But why gift deed was executed . in May 2020 if property is registered in your name then it seems to be fine. if any notice comes then the defect have to be cured.
Dear Sir, Nothing to worry if anything happen the office of Sub-Registrar then you may approach High Court and get favourable order. Please give me rank after viewing my details. Please call me for further assistance.
Dear Client, The amount of stamp duty and the registration charges are the same with respect to the Gift deed also. The Stamp duty is in the name of the previous holder then have to go with the whole process of registration again to execute the stamp duty on the current holder. For more queries please contact. Thank You.
