Rental Feud

Hello Sir/Ma'am, I wanted your help regarding a situation which needs your legal expertise. So , The situation is I had given Rs.2100 as token money to a broker for a flat which was to be taken for rent and also paid Rs. 12100 as advance for advance money for the flat , No agreement had been made still and also just the drafting for the agreement was done. Now , Due to some circumstances I had to cancel the flat booking and the same was done before the date of handover. But it's been nearly 70 days , I've been requesting the broker to return the money but he has been making excuses regarding the same. Please guide me what action can be taken against him so as the money can be taken back.?? With regards, Rikraj
