Cheques and agreement both will work for money summary suit.
Dear client I am sorry to hear that but in this case you can send a notice for recovery of money and then file a legal suit for recovery of the money Order IV of the Code of Civil Procedure 1908 (CPC).
First put your name on cheque then present that cheque in bank and if cheque got bounced then issue him notice through lawyer demanding your money and if he refused to pay then File cheque bounce case in court through lawyer and issue him arrest warrant through court order.
As far as the validity of the cheques are concerned they are usually 3 months from the date of issue. But you can always file a suit for recovery in the civil court and claim your money back. But first of all it is advisable rather than going legally you should serve him/her a legal notice and in that notice you must write that either return my money back or face legal action which will be at your own risk.
