Time line for case filing - Loan recovery

I have given loan to my close relative on 15th July 2021 and they are not repaying the loan after several follow ups. I have served legal notice in May 2024 and they have responded by reply notice accepting the money received. But they donot give any clear date for returning money. What is the time line to file the case? somebody mentioned I have to file the case before 15th July 2024. can anyone advise how many days I have time to file the case. can I go for criminal case or civil case. Please advise. thanks.

3 year limitation period.

There's a limitation of 3 years that is provided under law within which you can file a recovery suit to claim your money back. You can also claim it after that but for that you need to file a separate condonation application along with the recovery suit. But there is no limitation of doing a criminal case against him.
