Rajasthan High Court orders stay on OBC reservation bill of state government

The Rajasthan High Court on Thursday stayed the implementation of the other Backward Classes Reservation Bill of the state government. Recently, the Rajasthan Assembly had increased OBC reservation from 21% to 26% and in the bill a provision was made to give five percent reservation to the state’s Gujjar caste in OBC reservation.
The bench of Justice KS Jhaveri ordered the ban on the implementation of the OBC Bill 2017 while hearing the PIL on Ganga Sahay Sharma’s petition. The court said, politicians are dividing the country. In spite of the order of the Supreme Court in this case, the OBC Reservation Bill was passed in the Assembly in 2017. On October 26 this bill was passed in the Assembly. After the bill was passed, the OBC reservation increased from 21 to 26 and this total reservation has crossed the maximum limit to 54 per cent.
It is notable that Ganga Sahai Sharma had challenged the constitutionality of this bill. Earlier, the Rajasthan High Court had issued notices to the Chief Secretary, ACS Social Justice and Chief Personnel Secretary on this petition. After hearing the case, the court had said that if the state government does any work in relation to this bill, then it will be considered to affect the pending case in the Supreme Court.
