Supreme Court seeks opinion from Attorney General on MP, MLA’s Legal Practice

The Supreme Court has sought the opinion of Attorney General K.K. Venugopal on a petition seeking permission to ban MPs, legislators and members of the Legislative Council for Legal practice. The petition has been filed by BJP leader Ashwani Kumar Upadhyay. In the petition, he has cited the rules of the Bar Council of India (BCI), which prohibits lawyers from practicing during the time of being a member of parliament or state legislatures.

While hearing the matter, the Chief Justice, Deepak Mishra and the bench of Justice AM Khanvilkar said that the petition should be given in the Central Agency so that the Attorney General can give his opinion to the court on this issue. The next hearing in the case will be on March 12, 2018.

In the petition, Ashwani has appealed to the lawmakers not to allow the dual role of practicing the law, as it comes to conflict of interest. It is also a breach of the rules of the BCI.
