My spouse, somehow, hacked into my phone. Either by knowing the pin or by hiring experts. My spouse has some data like explicit pics, emails, and WhatsApp chat details. I am being threatened for mutual divorce and transfer of property. Otherwise, the data would be presented in court. My question is: 1. The hacking done by my spouse, by whatever method, is it legal? 2. Will this data be acceptable as proof of adultery in court? 3. Can I sue/file a case against my spouse under IT Act or Right to Privacy act?

1. hacking is illegal, 2. the data can be produced and even acceptable/admissible in the Court, if relevant, 3. yes, you can file a police complaint against the spouse for such an illegal act, by the way, who are you, husband or wife?
