Question Is About To Section 138 NI ACT

my question is if complainant did not remember when did he give huge amount in cash in advance than why dose judge not assume that this is fraud case, two person filed 138 csses on my parents about rs 60 lacs and in court they said they dose not remember the date when did they give huge amt, and both lower and sessions court judges also said it's not important when if complainant not remember the date.
