I am working in cantonment board office. One of my colleagues was appointed as a chowkidar on compassionate appointment (in place of his father) in the year 2015. On 11 -03-2020, he was expired due to dengue at the age of 32 and he was unmarried leaving behind his mother and unmarried elder brother. My question is that whether his elder brother is eligible for compassionate appointment. Because our office is denying his appointment stating that his brother cannot be appointed as the deceased was on compassionate appointment. Kindly guide us on the rules and any SC judgments regarding this.

Basically the Class-I legal heirs of the deceased can be accommodated under the normal cases of appointment. But in cases of compassionately appointed candidates the rules are otherwise.
