I have purchased a Rental Plan on NoBroker.com with a postpaid plan at the time of the agreement they have clearly mentioned post lockdown I will be informed before the money gets debited automatically from my Card. But without any prior intimation, they have deducted money from my account this was happened in June and I've been chasing them continuously from June 2020 they keep on delaying intentionally as they know it's their mistake. Finally, in December they agreed it's their mistake but they can only refund half of it even I agreed to that as well but they keep on saying I will receive the money with in 2-3 days and it's 3 months now still they did not refund. Their intentions are very clear they want me to forget this by myself either by being busy with my work or by getting tired of chasing them and failed in getting a response. So I have decided to send them a legal notice and claim compensation as well so please advise what will be the consequences and how to proceed further.

Yours is a Case of deficiency in service. To initiate the process you should get a legal notice served upon the company and then file a Complaint if the matter is not resolved. Hai, In your case, a breach of contract has occurred. The terms of a contract are what guide the parties in what they must do and how they should do it in order to maintain their promise. If a party does not do what the contract instructs that they do, then the non-breaching party will be allowed to take legal action and can file a lawsuit against them in court.
