Good day sir /madam my wife had file false 498a and DV case against me and my family members ,she also alleged my brother in law for sexual assaults can my bro in law file defamation case against her.And if he can what is the process.as he stays in Maharashtra and myself and my mother are from Karnataka.we want to file a case in Maharashtra ,what if she doesn't accept the notice .what is the legal way to give her a notice.

Your brother in law can file defamation case against your wife only after his acquittal in the molestation case filed by her against him. It is therefore advisable for your brother in law to contest the molestation case and after his acquittal he may file defamation case against her.
