You cannot file defamation case directly in a High Court. You can file complaint for the offence under section 499 and 500 of IPC. It is on criminal side. You can also file civil case claiming damages and compensation for defaming your image and reputation in the society. In this civil matter you have to pay court fee upto 10% of claimed amount. Choice is yours.
1) Defamation case cannot be filed in High court directly.. Exception: Only in chartered High courts having original jurisdiction i.e. Madras, Mumbai & Kolkata when the quantum claimed is more than 1 crore.. (this limit differs but definitely in crores) u can file.. which is literally not possible in your case.. 2) Defamation is hardly maintainable against wife, there are many if-s & but-s better consult a lawyer with all papers.. t 3) Defamation is different from "Malicious Prosecution".. yes, you can. you can file the case valued at over 3 crores to be on the safe side. however, you'll have to furnish and submit a very high Court fees for this.
