They are forbidden to charge the excessive rate of interest. Approach the Court with certified copy of the AGM and get the verdict accordingly. That will settle the issue forever. Please give me Rank Five and follow me after reviewing my resume and book a consultation for further discussion and explanation if required.

It is common sense which your society does not have that bye-laws can never overrule Act. a child can never grow older than mother. The bye-laws takes power from Act itself so bye-laws can never get more powers from Act. You can definitely make complaint to registrar of society. You can also file case in consumer court for refund if you paid.

Hi, No they cannot charge more than what the Act states. No, they cannot by pass the Act by enacting any by-laws. All by laws has to be within the ambit of the Act. It cannot be contrary to the provisions of the Act. You can approach the Dy. Registrar of the Societies, and file a complaint against the said society for all the irregularities committed by them.
