Additional Maintenance Charged From Tenant From Dwarka Society- New Delhi

Are there are judgement from a court in NCR putting a cap on extra maintenance charged from the tenants (on top of what is charged from the owners) in societies . In our society , there is extra 500 from the tenant on top of Rs3150 which a owner would pay - if he is residing in the flat instead of tenant. I have found this on the net "The tenant might be asked by the society to pay maintenance charges higher than the prescribed charges paid by the owner. The society is allowed to charge a maximum of 10 percent higher charge from the tenant only if the society can make a special case for it in front of the sub-registrar" however I am not sure if its valid of New Delhi Societies as well. I have been shown a document wherein the Management committee took this decision . Aren't they supposed to take permission from some Authority before making such rules . Otherwise its up Management Committee of the society to make any arbitrary rule - they may start charging tenants double the amount.
