Muslim husband can give divorce to his wife without her consent , without assigning any reason . All that is necessary is that the husband should pronounce talaaq; how he does it, when he does it, or in what he does it is not very essential.

Though a Muslim woman needs to file a petition for divorce if she wants to divorce her husband, there is no law requiring a Muslim to file a divorce petition to divorce his wife. It is because talaq is prescribed as the normal norm of divorce for Muslims. If the marriage is solemnised according to Muslim procedures and if both the parties are Muslims, then it is debatable. But there is no specific legal provision enabling you to file divorce petition, whereas a Muslim woman has it. As a test case you can try filing a divorce petition under the provisions which enable the women to do the same.
